Mayuri Daya is the founder of the firm. She is an admitted attorney of the High Court of South Africa. She graduated with a Bachelor of Laws from the University of Cape Town where she then pursued a Master’s degree in Maritime Law. Mayuri is known for her warm yet professional attitude with clients and believes in fighting for their rights. In her spare time, she enjoys listening to music and hiking.
Insolvency Litigation
Insolvency occurs when the liabilities exceed the assets of a Debtor. Often, Debtors do not know how to get out of financial distresses in which they are in. One such remedy is to have their estate sequestrated.
Sequestration Application
We prepare an application to the High Court to sequestrate the debtor’s assets on behalf of either the debtor or the creditor.
Liquidation Application
We prepare an application to the High Court to liquidate the company or close corporation.
Sequestrations
There are 2 ways to sequestrate the estate of the Debtor (a natural person) :
1.Voluntary Surrender
2. Compulsory Sequestration
A voluntary surrender is where a Debtor can voluntarily wish to sequestrate his or her own estate. Here, an application is made by the attorney on his or her behalf to the High Court. If the application is successful, the Debtor becomes an Insolvent.
A compulsory sequestration is where the Creditor applies for the Debtor’s estate to be sequestrated. Again, this is an application that is presented to the High Court on behalf of the Creditor and if the application is successful, the Debtor’s estate becomes sequestrated and the Debtor becomes an Insolvent.
Liquidations
There are two ways to liquidate a company or close corporation: voluntarily or compulsory:
1.Voluntary Liquidation
A voluntary liquidation is done by way of a special resolution by the company or close corporation.
A compulsory liquidation is done by way of an application to the High Court and it involves the Creditors liquidating the Debtor company or close corporation.
2.Compulsory Liquidation
